Example: A doctrine under which new laws regarding a particular subject validly made buy the national legislature are considered superior to pre-existing laws made about the same subject by lower legislatures (such as state or local legislatures) with the result that the pre-existing laws are either completely invalidated (because they are preempted in their entirety) or partly invalidated (because only parts inconsistent with the superior new legislation are preempted). Example: A state owns a railroad that operated in interstate commerce and uses guidelines to insure safety. Congress then passes legislation establishing greater safety requirements for railroads nationwide. Since congress has the power to regulate interstate commerce, its guidelines preempt the state guidelines and the state must follow the national requirements.
