Example: A contract whereby a party called surety agrees with a creditor to perform the obligations of a debtor to that the at credit in event that the debtor fails to perform them. Some jurisdictions distinguish contracts of guaranty on the basic that suretyship contracts typically involve a joint agreement among all three parties, whereas guaranty contract between the guarantor and the creditor (creating secondary liability for the guarantor).
