Example: Excuses either party from performing a contract where three conditions exit: (1) a contingency must occur; (2) performance must thereby be made "impracticable"; and (3) the non-occurrence of the contingency must have been a basic assumption on which the contract was made.
ឧទាហរណ៍៖ ជាការអនុគ្រោះ​អោយភាគីណាមួយ​ដើម្បីវៀរចាកការបំពេញកិច្ចសន្យា កាលណាលក្ខខណ្ឌបីយ៉ាងកើតមាន៖ (១) ព្រឹតិ្តការណ៍អនិមត្តត្រូវកើតឡើង (២) ការបំពេញកាតព្វកិច្ចមិនអាចធ្វើទៅបានដោយសារព្រឹត្តិការណ៍កើតមានខាងលើ (៣) ការមិនកើតមានព្រឹត្តិការណ៍​អនិមិត្តជាការសន្មត​ជាមូលដ្ឋាននៃការបង្កើត​កិច្ចសន្យានោះ ។
